Ariel Solomon explains the Merit Systems Protection Board

Attorney Ariel E. Solomon Solomon discusses the Merit Systems Protection Board (MSPB). The Merit Systems Protection Board (MSPB) was created by Congress to hear complaints by federal employees who want to challenge an adverse employment action, like wrongful termination. The MSPB mainly covers adverse employment actions such as:

  • Termination
  • Removal
  • Suspension (over 14 days)
  • Whistleblower Retaliation

The MSPB has around 30 areas of jurisdiction, all governed by statute. Federal employees are generally covered by the MSPB unless a statute states otherwise. Employees of the intelligence community for example do not usually have MSPB appeal rights.
